1. Acceptance of Terms

These Terms of Service ("Terms") govern your engagement with Earthline Excavations ("we", "us", "our"), including all use of our website at

earthlineexcavations.com.au and any services we provide to you.

By submitting a quote request, confirming a booking, or engaging us to carry out works on your property, you agree to be bound by these Terms. If you do not agree, please do not proceed with your enquiry or engagement.

We reserve the right to update these Terms at any time. The current version will always be published at the above URL. Continued use of our services after an update constitutes acceptance of the revised Terms.

2. Our Services

Earthline Excavations provides rural excavation, earthmoving, and related services across Victoria, including but not limited to:

Dam restoration and construction

Earthmoving and site excavation

Driveway and access road construction

Land clearing and fire break construction

Drainage and water catchment solutions

Horse arena construction and site preparation

Concrete slab and footing excavation

Retaining wall excavation and construction

Tank pad levelling and site preparation

We reserve the right to decline any project at our discretion. Acceptance of an enquiry does not constitute a binding commitment to undertake works.

3. Quotes & Pricing

All quotes provided by Earthline Excavations are:

Provided in Australian Dollars (AUD) and exclusive of GST unless otherwise stated.

Valid for 30 days from the date of issue, unless a different expiry is specified in writing.

Estimates only, based on information available at the time — including site conditions, scope, and access. Final pricing may vary if site conditions differ materially from those described or observed.

Important: A quote is not a fixed price contract unless explicitly confirmed in writing by Earthline Excavations. Variations in scope, ground conditions, material costs, or unforeseen site conditions may result in additional charges. We will advise you of any significant variations before proceeding where possible.

Disposal fees, council permit costs, and any third-party charges are excluded from quotes unless specifically listed as inclusions.

4. Bookings & Scheduling

A booking is confirmed when both parties have agreed on scope, pricing, and a commencement date, and any required deposit has been received.

Scheduled dates are subject to change due to weather conditions, equipment availability, or circumstances beyond our control. We will provide as much notice as possible of any scheduling changes and will work with you to find an alternative date.

We operate primarily across rural and regional Victoria. Travel and mobilisation costs may apply for projects outside our standard service area and will be included in your quote.

5. Your Obligations

As the client, you agree to:

Provide accurate information about the site, intended use, and any known hazards (underground services, easements, contamination, unstable ground, etc.).

Obtain all necessary permits, approvals, and council authorisations required for the works prior to commencement.

Ensure safe and adequate access to the site for our machinery and personnel.

Notify us immediately of any site conditions, changes in scope, or other factors that may affect the safe or effective execution of works.

Be present or have an authorised representative available at the commencement of works, unless otherwise agreed.

Earthline Excavations accepts no liability for damage or delays caused by inaccurate information provided by the client, or by hazards not disclosed prior to commencement.

6. Payment Terms

Payment terms will be stated on each invoice. Standard terms are payment within 7 days of invoice date unless otherwise agreed in writing.

A deposit may be required to secure your booking, particularly for larger projects. Deposit amounts will be specified in your quote.

Accepted payment methods include bank transfer (EFT). Other methods may be available — confirm with us at time of booking.

Overdue invoices may attract late payment fees at our discretion.

All prices are in AUD. GST is applicable and will be itemised on all tax invoices.

7. Cancellations & Delays

Cancellation by Client: If you need to cancel or reschedule a confirmed booking, please notify us as soon as possible. Cancellations made with less than 48 hours' notice may result in a call-out or mobilisation fee to cover costs already incurred.

Cancellation by Earthline Excavations: We reserve the right to cancel or postpone works due to unsafe conditions, equipment breakdown, or other circumstances outside our control. In such cases, we will reschedule at the earliest opportunity and no cancellation fee will apply.

Weather delays: Earthmoving works are weather-dependent. We will not commence or continue works where conditions pose a safety risk or would result in poor-quality outcomes. Rescheduling due to weather is not a breach of contract by either party.

8. Liability & Warranties

Earthline Excavations holds appropriate public liability insurance. Details are available upon request.

To the maximum extent permitted by Australian Consumer Law:

Our liability for any claim arising from our services is limited to the value of the works performed.

We are not liable for consequential, indirect, or economic losses arising from delays, variations, or defects, except where required by law.

We are not responsible for damage to underground services or structures that were not disclosed to us prior to commencement.

Nothing in these Terms excludes or limits any consumer guarantee or other right that cannot be excluded under Australian Consumer Law (Competition and Consumer Act 2010 (Cth), Schedule 2).

9. Website Use

The content on our website is provided for general information purposes only. We endeavour to keep information current and accurate but make no warranties about its completeness or suitability for your specific situation.

Our website may contain links to third-party websites. We are not responsible for the content or privacy practices of those sites.

You must not use our website in any way that could cause damage, disrupt access, or compromise our systems or data.

10. Governing Law

These Terms are governed by the laws of the State of Victoria and the Commonwealth of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

We encourage clients to contact us directly to resolve any concerns before pursuing formal dispute resolution. We are committed to fair and transparent communication and will always seek to find a reasonable solution.
